General terms and conditions of the PRINTERIEUR® website

1. Scope and Contracting Parties
The following General Terms and Conditions (GTC) apply to the use of our website by the user and which he acknowledges by entering the website.

2. Use of the Website
Use of the website is free of charge. Its purpose is only to view and select the motifs stored there for later orders, if desired, for textiles digitally printed with the respective motifs from PONGS GROUP GmbH & CO. KG.
To do this, the website user selects the respective order number for the motif they want so that it is available as a reference for the production of the prints. The actual ordering process, the ordering of the desired prints and all other necessary steps are then carried out by directly contacting PONGS GROUP GmbH & CO. KG (www.pongs.de) or one of its contractual partners.

3. Artist Motives
All works of art acquired/created within the scope of your orders from PONGS® are exclusively acquired within the scope of the respective order in connection with a print order to be carried out by PONGS® and remain the property of PONGS®. Duplication or other use is prohibited.
All print data from PRINTERIEUR® is held by PONGS®, you cannot upload or make your own data available. All types of print data handling that do not relate to PRINTERIEUR® motifs are also not PRINTERIEUR®’s area of ​​responsibility.
Images supplied by PONGS® have certain scaling limitations and their maximum image size may not be suitable for certain wall specifications. The recommended, maximum printable dimensions of each file are guidelines and are shown on our homepage. Please inform yourself about this for the motif you have selected. A print with larger dimensions is possible in principle, but leads to a corresponding loss of quality due to the resolution of the respective motif.
All works of art represent a subjective argument only and PONGS® is not responsible for the final selection of individual motifs by the website user. PONGS® is only the moderator and print service provider. If the quality of the images is in question, PONGS® can send scaled previews (enlarged or reduced) for approval. In addition, we recommend the creation of a preprint for a fee as part of the aforementioned ordering process.
PONGS® is not liable for any damage or contamination that occurs during installation or subsequent use of the textiles.

4. Liability
We are always fully liable for claims based on damage caused by us, our legal representatives or vicarious agents
– in the event of injury to life, limb or health
– in the case of intentional or grossly negligent breach of duty
– in the case of guarantee promises, if agreed
– to consumers
In the event of a breach of cardinal obligations due to slight negligence on the part of us, our legal representatives or vicarious agents, the amount of liability is limited to the damage that was foreseeable at the time the contract was concluded and the occurrence of which must typically be expected. Cardinal obligations are essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the compliance with which the contractual partner can regularly rely.
For the rest, claims for damages are excluded.
The sole and unrestricted responsibility for the data you transmit (print data, address data for product personalization, billing and delivery addresses) lies with you as the customer. In this respect, we cannot assume any liability for the correctness of the content of the aforementioned data.
If the rights of third parties are violated by the fulfillment of the order, you will indemnify us against all resulting claims and claims for damages that are asserted against us, as well as from the costs of legal defense against proof.

6. Governing Law and Jurisdiction
If you are an entrepreneur, then German law applies to the exclusion of the UN Sales Convention.
For contracts with merchants, legal entities under public law or special funds under public law, the exclusive place of performance and jurisdiction is our registered office in 40474 Düsseldorf, Federal Republic of Germany.
